1. GENERAL CONDITIONS

By using our Services, you confirm that you are at least the age of majority in your country of residence, or that you are using the Services under the supervision of a parent or legal guardian.
We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion if we believe there has been misuse or a breach of these Terms.

2. OUR PRODUCTS

Von Alpen offers lifestyle apparel and accessories produced on-demand, including but not limited to t-shirts, hoodies, sweatshirts, beanies, socks, tote bags, hats, and similar items.
We strive to display our products as accurately as possible, but color and appearance may vary depending on your device and screen settings.
All product details, pricing, and availability are subject to change without notice. We reserve the right to discontinue any product or limit quantities at any time.

3. ORDERS AND ACCEPTANCE

When you place an order, you are making an offer to purchase products under these Terms. Orders are only accepted once payment has been successfully processed and a confirmation email has been issued.
We may refuse or cancel an order for reasons including suspected fraud, incorrect pricing, stock issues, or breach of these Terms.
All purchases are subject to our Return & Refund Policy.
Products are sold for personal, non-commercial use only.

4. PRICES AND PAYMENT

All prices shown on our website are final under the Kleinunternehmerregelung (§19 UStG) and therefore do not include VAT.
Prices do not include shipping, customs, or import duties where applicable.
You agree to provide accurate and authorized payment information. By submitting payment details, you authorize us (and Shopify as our payment processor) to charge the full order amount.
We reserve the right to correct pricing errors and cancel any order based on incorrect or outdated pricing information.

5. FULFILLMENT, SHIPPING & DELIVERY

All products are printed, packed, and shipped by a trusted European fulfillment partner operating printing hubs within the EU and the UK.
Orders placed from within the EU are fulfilled and shipped from an EU location; orders from the UK are fulfilled locally from the UK.
Typical delivery times are 7–14 business days, depending on production time, destination, and carrier performance. During peak seasons, delays may occur.
Once the order has been handed to the shipping carrier, the risk of loss or delay transfers to the customer, as is standard under EU e-commerce practice.
We are not liable for delays caused by carriers, customs processing, or events beyond our control.
Customers outside the EU (e.g. UK) are responsible for any applicable import duties or customs fees.

6. RETURNS AND EXCHANGES

Returns are accepted within 14 days of delivery, provided the items are unworn, unwashed, and with original tags and packaging.
Customers are responsible for return shipping costs unless the item is defective or incorrect.
In case of manufacturing defects or fulfillment errors, please contact support@vonalpen.com with photos and order details. We will cover return shipping and issue a replacement or refund after inspection.
Returns must be sent to our Munich address listed below. Items sent without prior approval will not be accepted.

7. RIGHT OF WITHDRAWAL (EU CUSTOMERS)

If you are an EU consumer, you have the legal right to withdraw from your order within 14 days without providing a reason.
To exercise this right, contact us at support@vonalpen.com before the withdrawal period expires.
Returned goods must be in original condition, and you are responsible for return shipping costs unless the item is defective or incorrect.
Refunds will be made to the original payment method after receipt and inspection of the returned goods.

8. THIRD-PARTY SERVICES

We use selected third-party providers to operate and fulfill our Services (e.g. printing, logistics, and payment processing).
These partners process personal data only as necessary to perform their tasks and in accordance with data protection laws.
We are not responsible for the content, policies, or performance of external websites linked to or from our Services.

9. INTELLECTUAL PROPERTY

All content on the website, including the Von Alpen name, logo, product designs, photography, and text, is the property of Von Alpen (Alperen Öztürk) or its licensors and is protected by applicable copyright and trademark laws.

Our Services and all products are provided “as is” and “as available”.
We make no representations or warranties, express or implied, regarding the operation, reliability, or suitability of the Services or products.
Nothing in these Terms limits your statutory consumer rights under German or EU law.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Von Alpen and its owner shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or use, arising from your use of the Services or products.
This limitation does not apply to liability for intent, gross negligence, injury to life, body, or health, or for obligations under mandatory consumer protection laws.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Von Alpen, its affiliates, and service providers from any claims, losses, or damages arising from your breach of these Terms or violation of applicable law.

13. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer in the EU, the mandatory protections and jurisdiction of your country of residence remain unaffected.
If you are a business, the exclusive place of jurisdiction is Munich, Germany.

14. ONLINE DISPUTE RESOLUTION

We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
